Design Terms & Conditions
The Terms & Conditions listed below are applicable to all products and graphic design services provided by Sweet Petite. In the event of a dispute, the laws for New Zealand will apply.
All work carried out by Sweet Petite is done on the understanding that the client has agreed to these readily available Terms & Conditions.
A proposal for your project will include any pricing including quotes or estimates in writing.
ACCEPTANCE OF TERMS & CONDITIONS
Your acceptance/ placement of order will be your agreement to begin work and acceptance of these Terms & Conditions, whether via website order or in writing via email, direct mail or private message on social media. In doing so, you become bound by these Terms & Conditions. The customer may not determine the Terms & Conditions by which their order will be completed. These Terms & Conditions are available freely on this website, www.sweetpetite.co.nz.
Unless otherwise agreed, upon completion of your order an invoice/order will be emailed to you for payment via Sweet Petite's website.
Payment options include debit/credit card and Laybuy (via www.laybuy.com.) If you would like to make payment in another form (i.e bank deposit) please ask us. Please make your payment within 7 days from date of invoice/order. If you are unable to do so, please discuss with us prior to us beginning your job.
Should you choose not to continue using Sweet Petite for your design needs, an invoice/order will be emailed to you for payment for works already completed. This charge may be up to 75% of the price agreed upon in your proposal.
Accounts that are outstanding 30 days from the date of invoice will incur a late payment interest charge at The Reserve Bank of New Zealand interest rate plus 5%, on any outstanding amount from the date of invoice until payment is made in full.
An account will be considered defaulted if it remains unpaid for 30 days from the date of invoice. Sweet Petite reserves the right to remove any works from any and all systems until the amount owing has been paid in full. This does not remove the customer's obligation to pay for the services provided.
Customers who default agree to pay any all Sweet Petite's reasonable fees (legal, accounting, debt collection or otherwise) in the event of Sweet Petite needing to enforce these Terms & Conditions.
You may not release any work done by Sweet Petite until payment has been received in full.
You may not use, release, alter, distribute, copyright etc any works created by Sweet Petite (or contractors) for the customer without written permission of Sweet Petite.FILES
Sweet Petite will provide proofs as needed in low resolution PDF for on screen viewing or PNG files, depending on the requirements of the job.
Unless otherwise discussed, charges for design work will not include the release of source files including but not limited to AI, EPS, INDD and PSD. If you would like these files for another designer or for your own needs, there will be a separate 'buy out' charge for Sweet Petite to supply the files.

Flat rate of $6.00 applies and your order is sent via tracked courier.
Please note: We are unable to deliver to PO Boxes so please provide a physical address.
If your parcel is returned to us and efforts have been made by our courier company to contact you, then there will be a charge for reshipping your order. This is payable online as you would for an order placed through the website. The price will range from $6 to $8.50 depending on the size of the parcel.
Copyrights are held by Sweet Petite on any logos, concepts, developments, words, pictures, ideas, illustrations and any visual work unless Sweet Petite specifically approves you to use. This approval will be in writing. Once your costs have been settled, you will own copyright for any final files you receive.
Where multiple designs have been presented and one chosen, only that design will be handed over and our contract is considered fulfilled. Any concepts unused remain the sole copyright of Sweet Petite and may be used for future projects, unless otherwise agreed in writing.
By supplying any imagery and text to Sweet Petite, you declare you are the sole copyright/trademark owner and are legally entitled to use it. Sweet Petite does not provide any fonts that require licensing for commercial use within your final files, this remains the responsibility of the client.
The customer agrees to release Sweet Petite fully from any claims arising from the misuse of copyrighted material supplied by the customer. It is the customer's responsibility to get all required permissions.
OTHER DESIGN WORK
The customer agrees that works outside the scope of the original proposal, or where the customer alters the designs significantly, will be subject to another proposal and require additional payment. On acceptance of the proposal, an invoice for 100% of the total agreed upon will be emailed for your payment before any additional work will begin.
Sweet Petite is not responsible for any amendments made by third parties before or after a design is published.
Any time frame is given as an estimation and Sweet Petite cannot be held responsible for over-runs, whatever the cause may be.
Where no work has taken place for your accepted proposal, you may cancel in writing and thus end your job request. Any cancellation after work has begun will incur charges for any work completed. This includes 'no-show' customers after receiving any works in any form - concept, development or otherwise. Sweet Petite will retain ownership of any designs, you are paying for the time spent on your works.
The Terms & Conditions listed here override any previous Terms & Conditions given in any form. Sweet Petite reserves the right to change any of these Terms & Conditions without notice at any time.
